Let me start this by saying this is my experience from earlier today and I do live in a blue state. I’m also posting it in truscum to get more attention, even if I’m periodically considered too extreme by some here.

I went to get my name and gender updated on my passport today. I’m 25, my last one was done when I was 14, so I needed to do it all in person. I was required to have the following paperwork:

  • current drivers license
  • birth certificate (original and photocopy)
  • DS-11 form
  • old passport (expired)
  • name change court order

To change just your sex on the passport, you don’t need a court order - yet. You need it for the name change portion, however.

When I presented my paperwork to the attendant, she told me that I was doing this at the absolute worst time because there’s so much uncertainty. With the executive order Trump passed declaring that there are only two sexes, she and the rest of the staff were unsure how it would affect trans people changing their sex from one to the other on passports. Nothing has been told to them regarding binary trans people yet.

She did say that they have been told to halt accepting X passport changes. That was the only thing she was certain of.

We completed the process and she said everything should be fine, but urged me to let others know to get things processed as soon as possible, as she has no idea how long this will be okay for or if mine will even be accepted. Hopefully the court order, the physician notes, and all of my documents being male for the last three years will help with any issues, but I digress.

As of right now, passports will not be changed to X if you apply today or after, according to the post office agent I spoke to. Binary trans people should be fine at the moment. I will update when I get my passport back, as I paid for expedited processing and should find out in two weeks or so.

Stay safe.
