We got hit by water damage in our apartment when the upstairs neighbors’ sprinkler went off. It dribbled pretty bad into our apartment and there is a lot of damage to our furniture. The ceiling had a crack prior to this incident which the landlord did not want to fix (instead painted over). It mostly dribbled through this crack but also through a couple other areas. My questions are:

  1. How is my landlord liable for the damage if this crack was present before and was not properly fixed?

  2. What are my rights as to the repair? They are currently drying the apartment and in the next few days they will likely fix the ceiling (I hope). I want to make sure they fix it properly. I don’t want this painting over it thing again. There might also now be serious structural damage because of all the water, and I don’t know yet how they will try to repair this.

  3. My family and I were out yesterday and came back home when damage had occurred about 2.5 hours before. They did not call us. The neighbor told me that “they” (not sure who they mean) could not reach us because they dont have my number. The apartment complex has my number though. We could have probably saved my some of our belongings if we were notified in a timely manner. Is this a point I can make them liable for some of the damage or did I just have “bad luck”?

I have renters insurance, but I also want to make sure they do right by their responsibilities. I am sure they will try to cut corners, so when I talk with them tomorrow, I want to be better informed as to my rights.
