So I work for a major drugstore retailer as a dock worker unloading trucks and I’m in the union. A couple months ago I put in for a week of my vacation days for the 2nd week in July, which was denied. Last weekend, I was in an accident and broke my elbow (non work related) so the doctor informed me that with my cast, I will not be able to work for 6-8 weeks.

I filled out my disability paperwork and when I spoke to HR yesterday, they told me that since I was going to be out of work anyways, they were going to go ahead and approve my vacation now.

This seems illegal to me. I already filed for disability, which will cover that week already. Is it legal for them to now take my vacation time when I’m already approved for disability on the same days? I feel like they’re punishing me for being injured. Can anyone advise on this? Do I need to talk to my union rep?
