I had a car accident on Monday where a MiniVan hit my car from behind. The damage looked quite big and it’s even worse as my car (Tesla Model 3) is only 18 months old.

First I was not worried as it wasn’t my fault and I have fully comprehensive insurance. Now that situation changed dramatically as it turned out:

  • Expert of Insuarance evaluated the damage to 5.000 € only (which looks way to less in my experience and I’m bit worried they might have overseen some structural damages)
    • But they refuse to provide me anything in writing, if I insist they told me I shall wait 2 more weeks
  • There is no such thing as “Compensation for Loss of Value” in Luxembourg
  • Insuarance only allows a Rental Car for maximum 3 days (while delivery of spare parts take already 10) and for maximum of 25 €/day (Where actually do you get a rental car for that price?)
    • Ridiciouls enough I was told I can drive the car in the meantime even though the trunk does not close anymore so it can rain in - Insurance said “Well it shall not rain the next days”

So someone hit my almost new car which causes big loss of value, I have no exchange car nor any compensation for not having a car. I had a call with a lawyer who told me “That’s what it is in Luxembourg”, so is it really like that in Luxembourg? Only knowing how it works in Germany I’m a bit puzzled
