We bought in this rural HOA about 5 years ago. Only a few dozen houses and a dozen more vacant lots, about 2/3 don’t live here it’s a 2nd property for them. At the time, the realtor put us in touch with the supposedly HOA president. They emailed me what they said was their declarations. They had nothing questionable and everything looked good. We bought the house after reviewing them.

Several times since then, we’ve had supposedly valid owner votes on new versions. Again, none of the new versions were recorded as required by our state. No problems to anyone here about that! (And I didn’t know any better, never been in HOA, how would I know about that?)

We’re built a few rental houses, small cottages. Finished one about 3 years ago, another about a year ago. That’s it we’re done, that’s all the land we could buy, 3 parcels total.

Then all of a sudden, I get word a bunch of the owners that have been here 20+ years basically hate us. Never wave. Stupid fuck face mean look when we drive by. Always complaining about amount of traffic on the private road. Come to find out they think we’re in violation because they think the recorded documents are valid so no rentals are allowed. The documents we’ve received, and voted on, since the, have no rental restrictions.

Our HOA also has no regular meetings (board meetings are not announced or open to members, minutes not available), doesn’t provide proper financials or reports of any kind, never has licensed and insured people doing maintenance. (No plans or funds to fix anything, everything is just band aide fixed when it’s busted.) Never had insurance, or filed tax returns. Both the corporate address and registered agent as on the secretary of state are defunct, hold elections without proper notice, count completely anonymous ballots mailed, emailed, or called in, themselves.

Basically these stupid fucks just do whatever the fuck the want, and that’s that. They’ve said and put in writing that our state laws don’t apply to them. And upon asking when the board meetings were, they said the only opportunity for any owner to be involved or ask questions or see what is happening was to run for board and get elected. (Run for the board that wouldn’t meet even when already did that and was a board member!!) The story goes on and on.

So the shit fucks doing all this stupid shit with the Declarations are shit fuck rude people. And the others who’ve been here the longest don’t even know what they did. Wow this seems like fraud.

Before you say become a board member, already did that. Year 2 and year 4. First year I resigned because they didn’t want to hold any meetings, not even among board members. 2nd time, after I suggested we use a licensed contractor for something, they had a sudden unscheduled vote to elect a new board.

Don’t know what we could’ve done differently. We relied on our realtor and title company to inform us and never owned in an HOA before.

Everyone should do their due diligence when buying into an HOA, even attend a meeting, look at ALL their records, etc… The only solution here is to sue. Already saving up.

Phew rant over. Saving for that lawyer. (Good thing our state allows for attorney fees of prevailing party!!)

Edit: it’s a rural HOA and the only property is a private dirt road which they maintain, but culverts are crumbling and busted, road base is exposed, big ruts everywhere. They do repair it, mostly themselves but never any licensed contractors, and only the bare minimum no advanced planning or proper repairs. Would love to disband it, but then how would we maintain the road? I’ve heard the only way to do that is 100% agreement to add deed restrictions and a road maintenance agreement. Not sure these stupid fucks would pay up and it could be even worse if we didn’t have any HOA.
