A FL HOA has successfully argued that they are a voluntary social club and can terminate property rights at will, but doesn’t that also mean that they cannot compel membership and thus dues? In my limited legal understanding, I think they just eliminated their legal tie to the land. The same HOA is also appealing another judgement against them from when they illegally assessed members for a capital improvement that they called maintenance, the court ruled that the protesting homeowners only had to pay for maintenance/operations, so now they just call the entire budget operations.
