So my house was built in the early 90’s, the original fence is still here, my neighbor built a new fence tied into mine crossing (at my estimate) between 6-16 feet onto my property.

I am currently waiting on surveyors to come mark the property line.

Assuming my suspicions are correct, I intend on telling my neighbor he need to remove where it is tied into my fence and build his fence on his property line.

My question is that according to the HOA double property line fences are not allowed, and fences must extend to the edge of your property.

Due to my fence being the original fence from the original developer, would my fence be essentially grandfathered in, or could they force me to rebuild my fence to the edge of my property line.

The big issue here is that the area in between our houses was prior to him cutting it all down a wall of green and now I have no property in my backyard and my second level master bedroom can be seen into from his backyard. And I want that space back and not fenced in by either of us as a natural wall.

So my intent is to kick him off my property, not move my fence and replant, or sue him to replace, all the greenery that was cut down.

I will be getting a lawyer for that part, but I mainly just wanted options on if my fence would be grandfathered in?
